DEFINITIONS:

Brooks' Place is the vendor of BBQ dinners as described below. You are the client. All BBQ events are expected to be at the client furnished facilities. The client agrees to provide access to the premises/facilities a minimum of 1 hour preceding the events scheduled meal serving time for setup and at least 1 hour following the end of the serving time for cleanup.

​ Serving will be cafeteria style with the client guests receiving portions in an orderly manner. This can be modified to Brooks' Place providing wait staff to serve the guests at their respective tables. A surcharge will apply for the use of wait staff.

​ All orders for an event will be placed no less than one month (30 days) preceding the event date.

 

 



SERVICES:

The catering services include:

​ · Buying and preparing the food;

​ · Monitoring the food on the table and keeping the table clean;

​ · Keeping the containers full;

​ · Clean up our area at the end of the event.

 

 



MENU/FOOD QUANTITIES:

Brooks' Place will prepare between 5%-10% overage of food based on the final number of guests we receive from you.

​ In case we furnish our employees or our contracted employees with any of the prepared meals, you will not be responsible for those people in your guest count.

​ Due to insurance requirements, NO menu item overage or leftovers will be provided to the client.

 

 



MENU ITEMS: 3 Meats and any 2 Sides

· Brisket

​ · Homemade Potato Salad

​ · BBQ Baked Beans

​ · Green Beans

​ · Roasted Garlic Potatoes

​ · Coleslaw

​ · Pickles

​ · Onions

​ · Peppers

​ · BBQ sauce

​ · Ice tea

NOTE: Additional Meats can be added, not substituted. Add $3 a person for Ribs, Pulled Pork, Ham or Turkey.

 

 



BEVERAGES:

The only beverages served by Brooks' Place is ice tea. Brooks' Place is not licensed to serve or provide alcoholic beverages of any kind. If alcoholic beverages are being served at this event, the client takes full responsibility for any actions, deeds, mischief, or damage caused by the client or the client guests. Brooks' Place's employees will not participate in the consumption of any alcoholic beverages while providing their services.

 



TIMELINE:

Each event is estimated at approximately 4 hours:

· 1 hour for setup;

​ · 2 hours for serving;

​ · 1 hour for clean-up.

Brooks' Place can shut down all serving activities in the event that it is deemed a health hazard to the client and their guests.



SERVERS:

If you want us to also serve your guests, an amount equal to 18% of the final total guest count billing will be assessed to pay for the servers' time and efforts. Any additional compensation that you deem appropriate for the wait staff will also be accepted.

GUEST COUNTS:

The initial estimated guest count will be supplied when you sign up below.

​ A final guest count is not subject to reduction and is due 10 days prior to your event date(s). If you need to increase your guest count, we will make every effort to accommodate your request. Additional fees and charges MAY apply.



KIDS/CHILDREN:

We do not offer a children menu. Everyone who is to receive a plate of food will be counted in the total number of people for this agreement.

 



PRICING:

NOTE: All pricing is subject to change without notice. Special conditions: In the event that the costs of the ingredients increase substantially within 10 to 30 days preceding your event, we may need to increase the quoted prices below. In this case, we will contact you via telephone or email to advise you of those changes.

DEPOSIT:

A 50% deposit (based upon the initial estimated guest count above) is due at time of signup. This agreement becomes binding upon receipt of your deposit.

 



SALES TAX:

Taxes for Texas residents located outside major metropolitan areas is 7.25%. Those located inside major metropolitan areas is 8.25%. The total sales tax will be applied to the final payment.

 



PAYMENTS:

Payments will be accepted through PayPal, Visa, MasterCard, Discover, Check, or Cash. If the final payment is to be by check, please pay at least 7 business days in advance to allow it to clear the banks.

​ For all events totaling $2,000.00 and above, the final payment for your event is due 3 days prior to your event date. Final Payment for your event is due the day of your event date for all other events.

 



BROOKS' PLACE CANCELLATIONS:

Brooks' Place reserves the right to terminate this agreement for any reason.

​ If Brooks' Place terminates this agreement over 30 days prior to your event date, all deposits and prepayments will be returned in full within 10 days.

​ If Brooks' Place terminates this agreement within 30 days prior to your event date, all deposits and prepayments will be returned in full within 10 days as well as an additional 10% penalty of all sums paid to Brooks' Place.

​ If an event that has been cancelled by Brooks' Place is rescheduled, the new event date will be considered a new event and the event being rescheduled will be considered cancelled by Brooks' Place.

 



CLIENT CANCELLATIONS:

If client terminates this agreement over 30 days prior to your event date, all deposits and prepayments will be returned in full within 10 days.

​ If client terminates this agreement 15 to 30 days prior to your event date, all deposits and prepayments will be returned in full within 10 days less $100.00. This includes any anticipated acts of God.

​ If client terminates this agreement in under 15 days prior to your event date, all deposits will be forfeited. This includes any acts of God.

 



CLIENT CHANGE OF EVENT DATE:

If client wishes to change the date of the event over 30 days prior to the agreed upon event date, Brooks' Place will apply the entire balance of your deposits and prepayments (less $100.00), toward another event. Subject to our availability. All costs are subject to change.

​ If such changes are to occur within 30 days of the event, all of the conditions in the previous section (Client cancellations) will apply.

 



INSURANCE:

We maintain general liability and automotive insurance coverage for ourselves and our employees.

 



DAMAGE:

Brooks' Place assumes no responsibility for ANY damage or loss of any merchandise, alcohol, equipment, furniture, clothing, or other valuables prior to, during or after the event. We will do everything possible to ensure that all of your supplies, rentals, and equipment are cared for and maintained in good working order and without any damage.

​ I, the client, understand that by using or providing items I own or are providing or by hosting an event in my home/office/facilities, that accidents/ breakage and damage may occur. I will NOT bill, charge or sue Brooks' Place for any loss unless the damage or loss was caused by the willful negligent actions or conduct of Brooks' Place or it's employees.

 



LIABILITY:

Brooks' Place's only liability, for third party claims, will be for actions caused by Brooks' Place and/or the negligent conduct of it's employees.

THIRD PARTY LIABILITY:

Brooks' Place assumes no responsibility for the conduct of guests, members of the family, and/or third parties hired to provide services.

UNLAWFUL ACTIVITIES:

The client will comply with all the laws of the United States and the State of Texas, all municipal ordinances and all lawful orders of police and fire departments, and will not do anything on the premises in violation of any laws, ordinances, rules or orders. If unlawful activities are occurring on the premises, and event is cancelled, there will be no refund of any kind from Brooks' Place to client.

ASSIGN ABILITY:

This agreement is not assignable without the written consent of Brooks' Place.
